Prices and availability are subject to change without any prior notice. Cancellation by SUNIRA.STORE:

Please note that there may be certain orders that we are unable to accept and must cancel. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. Some situations that may result in your order being cancelled shall include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, problems identified by our credit and fraud avoidance department or any defect regarding the quality of the product. We may also require additional verifications or information before accepting any order. We will contact you if all or any portion of your order is cancelled or if additional information is required to accept your order. If your order is cancelled after your credit card has been charged, the said amount will be reversed back in your Card Account. Cancellations by the Customer:

In case of requests for order cancellations, SUNIRA.STORE reserves the right to accept or reject requests for order cancellations for any reason. As part of usual business practice, if we receive a cancellation notice and the order has not been processed / approved by us, we shall cancel the order and refund the entire amount. A request for cancellation of order shall be valid and accepted only if they are made within 24 (twenty four) hours of making the order on the Site. We will not be able to cancel orders that have already been processed or orders for which request for cancellation is made after the expiry of 24 (twenty four) hours from making the order. Fraudulent /Declined Transactions:

Our fraud detection team constantly monitors the user’s account in order to avoid fraudulent accounts and transactions. Users with more than one account fraudulently shall be liable for legal actions under law and SUNIRA.STORE reserves the right to recover the cost of goods, collection charges and lawyers fees from persons using the Site fraudulently. Customer Dispute Resolution in case of sale of Coupons :

SUNIRA.STORE may provide deals pertaining to any services and the same shall be redeemed by you through coupons (“Coupons” or “Deal”) sold through the Site. In case any query pertaining to the use of Coupon, the Customer should notify or submit a request within 7 (fifteen) days from the date of unsuccessful use of Coupon. If you fail to contact us within a period of 7 (Seven) days, your order shall be deemed to be inaccurate and you hereby waive any right to dispute the order with SUNIRA.STORE. The Customer must notify SUNIRA.STORE immediately if the Coupon is lost, stolen, mutilated, not received or if the customer suspects that the Coupon is being used without his/her consent. Credit Card Details:

Billing :

The price of our merchandise is inclusive of the VAT. The vat charged shall depend upon the destination where the order has to be shipped. The tax rate applied to the order will be the combined tax rate for both state and local tax rates in accordance with the address where the order is being shipped. Duration of Sale:

Each sale may last up to one week only and the time of beginning of the sale is 11:00 hours IST. Therefore, it is the customer’s responsibility to login earlier if they want to avail better products or styles because SUNIRA.STORE sales are “first come, first served”. The merchandise is not restocked once sold out. No information regarding the presence of any Product in our stock will be given and we will alert you only when an item is sold out.

Returns and Exchange :

You acknowledge that these terms of returns and exchange are limited to direct sale by SUNIRA.STORE to you and that these terms of returns and exchange are not available in case of a sale by third party and invoice which shall be governed by the terms of such sale. For this purpose SUNIRA.STORE must receive the merchandise within 7 days from the date you receive an authorization mail. Items must be unused, unworn, unwashed and undamaged by you. Goods will be returned only if they are returned in their original packaging, including: hangers, poly bags, hang tags on garments and gift boxes. We will either give you a replacement or will give you a complete refund (In case of non-availability of the product), if the return is due to an error on our part (incorrect item sent, damaged/defective product). Also we will reimburse the invoice value as well as the shipping charge that you would bear to return the package in case of complete refund. All returns which are not valid will not be accepted and will be sent back. In such cases shipping charges will not be borne by us. Do send us a scanned copy of the courier receipt (without any overwriting on the amount) as soon as the package is couriered. We have sole discretion in deciding whether to accept the returns or not depending on the merit of the case. Refund Clause :

We will either give you a replacement or will give you a complete refund (In case of non-availability of the product), if the return is due to an error on our part (incorrect item sent, damaged/defective product). Also we will reimburse the invoice value as well as the shipping charge that you would bear to return the package in case of complete refund. All returns which are not valid will not be accepted and will be sent back. In such cases shipping charges will not be borne by us. Please also see our Return Policy for further information..

Offer, Schemes and Contest/Coupons Redemption

SUNIRA.STORE reserves the right to change/modify/add/delete any of the terms and conditions prevailing on the different promotional schemes (including but not limited to refer-a-friend and coupons) it introduces in market from time to time. SUNIRA.STORE at its discretion can withdraw a particular scheme from the website or market. The terms and conditions for such Contest shall be separately available on the Site. In the event of any conflict between these T&C and the terms and conditions pertaining to any Contest, such terms and conditions shall prevail. Delivery

SUNIRA.STORE endeavours but does not guarantee to deliver the products to customers within 4 weeks during normal days and from the day of close of sale depending upon the shipping location. SUNIRA.STORE works with different type of suppliers (Manufacturers, distributors, importers etc.) and the delivery time to customers is subject to delivery of products from supplier to SUNIRA.STORE. Other factors include delay in delivery through the courier partner; transporters’ strike etc. SUNIRA.STORE reserves the right to make delivery of the goods by installments. If the goods are to be delivered in installments, each delivery will constitute a separate contract. You may not treat the contract (as a whole) as repudiated if SUNIRA.STORE fails to deliver any one or more of the installments or if you have a claim in respect of any one or more of the installments. If you fail to take delivery of the goods, SUNIRA.STORE may at its discretion charge you for the additional shipping cost. Our terms and conditions pertaining to the delivery of the Products can be accessed here and we hereby assume that the same has been read and agreed by you. Further, SUNIRA.STORE may at times be unable to deliver the confirmed order(s) to you and the reason for the same could be inclusive of but not limited to the following: (i) unavailability of the relevant product; (ii) failure of the concerned manufacturer/supplier/importer to deliver relevant product to SUNIRA.STORE; (iii) poor/improper/defective quality of the relevant product ascertained through our quality audit process; and (iv) inaccuracies or errors in product or pricing information. In the event of any circumstance(s) as aforementioned; you shall not be entitled to any damages, monetary compensation and/or redeemable coupons. In case SUNIRA.STORE is unable to deliver the confirmed order(s) as mentioned hereinabove and the payment for such order(s) has been made by you through your credit/debit card, the amount paid by you while placing the order(s) on the Site will be reversed back in your card account. No refunds shall be applicable on the orders made by the Customer(s) under the Cash on Delivery (“COD”) option.

Termination and Survival of Terms after Agreement Ends

The Company may terminate this Agreement at any time. Without limiting the foregoing, the Company shall have the right to immediately terminate any passwords or accounts of the User in the event of any conduct by the User which the Company, in its sole discretion, considers to be unacceptable, or in the event of any breach by the User of this Agreement. Notwithstanding any other provisions of this T&C, or any general legal principles to the contrary, any provision of this T&C that imposes or contemplates continuing obligations on a party will survive the expiration or termination of this T&C. This User Agreement is effective unless and until terminated by either you or SUNIRA.STORE. You may terminate this User Agreement at any time, provided that you discontinue any further use of this Site. SUNIRA.STORE may terminate this User Agreement at any time and may do so immediately without notice, and accordingly deny you access to the Site, Such termination will be without any liability to SUNIRA.STORE. Upon any termination of the User Agreement by either you or SUNIRA.STORE, you must promptly destroy all materials downloaded or otherwise obtained from this Site, as well as all copies of such materials, whether made under the User Agreement or otherwise. SUNIRA.STORE’s right to any Comments shall survive any termination of this User Agreement. Any such termination of the User Agreement shall not cancel your obligation to pay for the product already ordered from the Site or affect any liability that may have arisen under the User Agreement.

You Agree and Confirm

Governing Law and Jurisdiction

This User Agreement shall be construed in accord with the applicable laws of India. The Courts at Indore shall have exclusive jurisdiction in any proceedings arising out of this agreement Any dispute or difference either in interpretation or otherwise, of any terms of this User Agreement between the parties hereto, the same shall be referred to an independent arbitrator who will be appointed by SUNIRA.STORE and his decision shall be final and binding on the parties hereto. The above arbitration shall be in accordance with the Arbitration and Conciliation Act, 1996 as amended time to time. The arbitration shall be held in Indore. The High Court of judicature at Indore alone shall have the jurisdiction and the Laws of India shall apply.

Miscellaneous

If any of these conditions are deemed invalid, void, or for any reason unenforceable, the parties agree that the court should endeavour to give effect to the parties’ intentions as reflected in the provision, and the unenforceable condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition. From time to time SUNIRA.STORE may offer special promotional offers which may or may not apply to your SUNIRA.STORE account. To avail of such promotional offers, you agree to be bound by any additional terms and conditions for these special offers which are laid down by SUNIRA.STORE. This T&C and the relationship between you and SUNIRA.STORE will be governed by the laws as applicable in India. Any disputes will be handled in the competent courts of Indore, India. The failure of SUNIRA.STORE to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches. SUNIRA.STORE does not guarantee it will take action against all breaches of this T&C. Except as otherwise, expressly provided in this T&C, there shall be no third-party beneficiaries to this T&C.
